The School Law Blog has the details of the U.S. Sixth Circuit Court of Appeals deadlock on Pontiac v. Spellings, NEA’s suit against the No Child Left Behind Act. The tie leaves the lower court decision in place, which was to dismiss the case.

NEA could appeal to the U.S. Supreme Court, but indications are that NEA has tired of the suit. The much-delayed appeals court non-decision means the U.S. Department of Education won’t have to cut a deal, and that’s good for the taxpayers.
