In case you missed it, a three-judge panel of the U.S. Seventh Circuit Court of Appeals upheld Wisconsin’s Act 10 in its entirety. While this ensures there will be no quick reversal of fortune for the state’s public employee unions, other legal challenges remain and more will certainly be conjured.
In a press statement, the Wisconsin Education Association Council signaled its intentions: “WEAC is in the process of reviewing the appeals court decision to determine the impact of this ruling and the organization’s next steps.” That’s merely shorthand for “We need to decide whether to continue this line of attack or move on to another.”
When it comes to labor issues, elections are rarely dispositive, and adverse court rulings almost always result in appeals, so don’t get too excited one way or the other.
